A 49-year-old man has been charged with operating with a high blood alcohol content causing death, operating while intoxicated third offense, driving while license suspended causing death and open intoxicants in a motor vehicle. These charges are related to a two-vehicle motor vehicle accident that occurred in Sumpter Township, Michigan.

According to reports, the man slammed his vehicle into the rear end of a minivan that was stopped at a stop sign. Police said the man’s vehicle was speeding when it struck the back of the minivan. A 12-year-old girl was in the third row of seats. She was critically injured and was taken by helicopter to C.S. Mott Children’s Hospital in Ann Arbor, Michigan. She later passed away. There were two other children in the minivan, including a 2- and 3-year-old.

The man’s blood alcohol content tested at nearly three times the legal limit. He is currently being held on a $1 million bond. His next court date is schedule for Aug. 10.

The man has a dozen previous convictions for drunk driving. His driver’s license has been revoked since 1990. While this is a horrible crime and involves the death of a child, this man has a right to have his case heard before a judge or jury.

If you are facing charges for drunk driving, an attorney can help you determine the strongest defense strategy for your case. Your attorney will review all of the facts of your case, including DUI reports, accident reports, medical reports, witness statements and more. Breathalyzer maintenance reports will be reviewed, as will officer certification and training on the machine. All of these things will be used to create a defense for you.
